Commercial Rent Arrears Recovery (CRAR) is a statutory enforcement procedure introduced through Tribunals, Courts and Enforcement Act 2007, Section 72 replacing the old common law. It allows landlords of commercial properties in England and Wales to recover unpaid rent by instructing enforcement agents (bailiffs) to seize and sell a tenant’s goods from the leased premises to cover the arrears, without the court order, the reason for this being that it is statutory regulated.

Forfeiture in Commercial Leases
Forfeiture occurs when a landlord exercises their contractual or statutory right to terminate a lease and regain possession of the property following a tenant’s breach.
This is achieved by the landlord exercising their contractual right to end the lease by gaining possession. A landlord may instruct their bailiff to do a peaceable re-entry and recover possession of their commercial property. This will then conclude the forfeiture of the lease. It is a very fast and effective way to get your property back, or to get a tenant at the negotiation table.
